    Achtergrondinformatie

    Roberto Branco Martins (7 juni 1977) behaalde in 2003 zijn diploma Nederlands recht aan de Universiteit van Amsterdam. Zijn afstudeerrichting was privaatrecht en Europa. Tijdens zijn studie werkte hij op een werving en selectiekantoor voor juristen en liep hij stage op een juridisch advieskantoor dat actief was in de internationale praktijk van het professionele voetbal. Zijn scriptieonderwerp "De eerste Europese CAO in het professionele voetbal" leidde tot een dienstverband bij de Federatie van Betaald Voetbal Organisaties (FBO), de werkgeversorganisatie in het betaalde voetbal. Bij de FBO was hij twee jaar werkzaam als manager European Affairs en ontwikkelde hij twee projecten die door de Europese Commissie met een subsidie gehonoreerd werden, hij werd projectmanager van de projecten "Promoting the Social Dialogue in European Professional Football" en "Promoting the Social Dialogue in the European Candidate Countries".
    Tijdens het onderzoekscomponent deze projecten kwam hij in aanraking met het T.M.C. Asser Instituut voor internationaalprivaatrecht en vanaf 2003 is hij betrokken bij het Asser international sports law centre.
    Na een jaar gewerkt te hebben op een advocatenkantoor in Amsterdam besloot hij om als directeur aan het werk te gaan van een belangenvereniging voor spelersmakelaars, Pro Agent. Tegenwoordig werkt hij tevens voor de internationale variant van deze organisatie, de European Football Agents Association.
    Naast deze activiteiten is Branco Martins werkzaam als Universitair docent Arbeid en Sport aan de Universiteit van Amsterdam. Zijn cursus is onderdeel van de Master Arbeidsrecht maar staat tevens open als keuzevak voor studenten aan de UvA of professionals uit de praktijk.
    Branco Martins' promotieonderzoek verricht hij aan Edge Hill University Noord West Engeland. Hij maakt daar tevens deel uit van de Centre for Sports Law Research.

    Lopend onderzoek

    "Collective bargaining in the European professional football sector".
    Professionele sport in de Europese Unie is een sector die valt onder een woud van regels. Op de ondernemingen en werknemers die actief zijn in de sector zijn verenigingsreglementen, arbeidswetgeving, Europees Recht, en veel andere bronnen van regulering van toepassing. De voetbalsector in de Europese Unie kenmerkt zich door eenhoge mate van mobiliteit van werknemers, het internationalekarakter van de arbeidsmarkt, de flexibiliteit in arbeidsrelaties, relatief jonge werknemers, een internationaal vergoedingensysteem bij de overgang van werknemers, disciplinaire sancties via arbitragecommissies, etc.
    De woud van regels in combinatie met deze sportieve specificiteit maakt dat er op de Europese arbeidsmarkt in het voetbal sprake is van juridische onzekerheid. In het promotieonderzoek staat de zoektocht naar juridische zekerheid centraal. De Europese Sociale dialoog wordt onderzocht als mogelijk instrument voor het creëren van de juridische zekerheid: een Europese CAO in het voetbal.
